This website is operated by Alternate Foods, trading as Big Bear Farms ("Big Bear Farms", "we", "us" or "our"), a business registered in India with its registered office at Johnsons Orchards, PO Raison, Dist. Kullu, Himachal Pradesh, India – 175 128 (FSSAI Licence No. 10920006000098). We offer this website, including all information, tools and services available from this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including the additional terms and policies referenced herein or available by hyperlink — including our Privacy Policy, Refund & Return Policy, Shipping Policy and Legal Notice, each of which is incorporated into these Terms by reference. These Terms apply to all users of the site, including browsers, vendors, customers, merchants and/or contributors of content.

Our store is hosted on Shopify Inc., which provides us the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 — ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least 18 years of age and competent to contract under the Indian Contract Act, 1872, or that you are accessing the site under the supervision of a parent or legal guardian who consents to these Terms. You may not use our products for any illegal or unauthorised purpose, nor may you, in the use of the Service, violate any laws of India (including but not limited to copyright and food-safety laws). You must not transmit any worms, viruses or any code of a destructive nature. A breach or violation of any of these Terms will result in immediate termination of your Services.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any lawful reason at any time. You understand that your content (excluding payment card information) may be transferred unencrypted and involve transmissions over various networks and changes to conform to technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission from us. Headings are for convenience only and do not limit these Terms.

SECTION 3 — PRODUCT INFORMATION, FOOD SAFETY & DISCLAIMERS

We are an FSSAI-licensed food business. All products are sourced, packed and dispatched in compliance with the Food Safety and Standards Act, 2006 and applicable rules.

Product images are for representational purposes only; actual appearance, colour and packaging may vary. Nutritional information and ingredient lists are accurate at the time of publication and are subject to change. Customers with specific dietary requirements or allergies must read the product label before consumption. Our products are natural/farm products and may show natural variation in size, colour, texture and taste; such variation is not a defect.

We are not responsible if information on this site is not accurate, complete or current. The material is provided for general information only and should not be relied upon as the sole basis for decisions. Any reliance is at your own risk.

SECTION 4 — PRICING, TAXES & PAYMENT

All prices are listed in Indian Rupees (INR) and are inclusive of GST unless stated otherwise. Prices are subject to change without notice. We reserve the right to modify or discontinue any product or the Service at any time without notice and shall not be liable to you or any third party for any modification, price change, suspension or discontinuance.

In the case of an obvious pricing error, we reserve the right to cancel the affected order even if it has been confirmed and/or paid for, and to refund any amount charged. We accept payments through our third-party payment processors (e.g. Razorpay, Easebuzz and PhonePe); your use of those services is governed by their respective terms and privacy policies. Cash on Delivery (COD), where offered, is subject to the conditions in our Shipping and Refund Policies.

SECTION 5 — ORDERS, AVAILABILITY & ACCURACY OF ACCOUNT INFORMATION

We reserve the right to refuse or cancel any order, and to limit or cancel quantities purchased per person, per household or per order, including orders placed under the same customer account, payment card, or billing/shipping address, and orders that in our sole judgment appear to be placed by dealers, resellers or distributors. If we change or cancel an order, we may attempt to notify you using the email, billing address or phone number provided at the time of order.

You agree to provide current, complete and accurate purchase and account information for all purchases, and to promptly update your account information (including email, phone and payment details) so we can complete your transactions and contact you as needed.

SECTION 6 — SHIPPING, RETURNS & CANCELLATIONS

Delivery timelines, serviceability, shipping charges and dispatch terms are governed by our Shipping Policy. Order cancellations, refunds and replacements (including the handling of perishable and damaged goods) are governed by our Refund & Return Policy. By placing an order you agree to those policies, which are incorporated into these Terms by reference.

SECTION 7 — OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools that we neither monitor nor control, provided "as is" and "as available" without warranties. Your use of such tools is at your own risk. Third-party links may direct you to sites not affiliated with us; we are not responsible for their content, accuracy or practices, and are not liable for any harm related to transactions with third parties. Please review the third party's policies before transacting.

SECTION 8 — USER COMMENTS, FEEDBACK & SUBMISSIONS

If you send comments, reviews, ideas or other submissions, you agree we may, without restriction, edit, copy, publish, distribute, translate and otherwise use them in any medium. We are under no obligation to keep them confidential, pay compensation, or respond. You agree your comments will not violate any third-party right or contain unlawful, abusive, defamatory or obscene material or malware, and that you will not impersonate others or mislead us as to the origin of any comments. You are solely responsible for the comments you make.

SECTION 9 — PERSONAL INFORMATION & DATA PROTECTION

Your submission of personal information through the store is governed by our Privacy Policy. We handle personal data in accordance with applicable Indian law, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023. By using the site, you consent to the collection and use of your information as described in our Privacy Policy.

SECTION 10 — MARKETING COMMUNICATIONS & USE OF DATA

By creating an account, placing an order, or subscribing through our site, you agree that we may use the personal information you provide (such as your name, email address, phone number, order history and browsing activity) for our own internal marketing and business purposes. Opting out of marketing will not affect transactional messages essential to your orders (such as order confirmations, dispatch and delivery updates). Our use of your personal data is further governed by our Privacy Policy and applicable Indian law, including the Digital Personal Data Protection Act, 2023.

SECTION 11 — PROHIBITED USES

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any laws, rules or regulations of India or any other applicable jurisdiction; (d) to infringe our or others' intellectual property rights; (e) to harass, abuse, harm, defame or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or malicious code; (h) to collect or track others' personal information; (i) to spam, phish, pharm, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent security features. We reserve the right to terminate your use of the Service for violating any prohibited use.

SECTION 12 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee that your use of the Service will be uninterrupted, timely, secure or error-free, or that results will be accurate or reliable. The Service and all products delivered through it are provided "as is" and "as available" except as expressly stated by us, without warranties of any kind, to the maximum extent permitted by law. To the fullest extent permitted by applicable law, Big Bear Farms and its directors, officers, employees, affiliates, agents, contractors, suppliers and service providers shall not be liable for any indirect, incidental, punitive, special or consequential damages, or any loss of profits, revenue, data or goodwill, arising from your use of the Service or any products. Where liability cannot be excluded under applicable law, our total liability to you shall not exceed the amount paid by you for the order giving rise to the claim. Nothing in these Terms limits any rights you may have as a consumer under the Consumer Protection Act, 2019 that cannot be lawfully excluded.

SECTION 13 — INDEMNIFICATION

You agree to indemnify, defend and hold harmless Big Bear Farms and its affiliates, officers, directors, agents, contractors, licensors, service providers, suppliers and employees from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

SECTION 14 — FORCE MAJEURE

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, epidemics or pandemics, floods, fire, weather damage to crops, strikes, transport or courier disruptions, aviation fuel shortages, government restrictions, or failures of telecommunications or third-party logistics providers.

SECTION 15 — SEVERABILITY

If any provision of these Terms is found unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed without affecting the validity of the remaining provisions.

SECTION 16 — TERMINATION

Obligations and liabilities incurred prior to termination survive termination. These Terms are effective until terminated by either you or us. You may terminate at any time by ceasing to use our site. If we suspect you have failed to comply with any provision, we may terminate this agreement without notice; you will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services.

SECTION 17 — ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision shall not constitute a waiver. These Terms and any policies posted by us constitute the entire agreement between you and us, superseding any prior agreements. Any ambiguities shall not be construed against the drafting party.

SECTION 18 — GOVERNING LAW & DISPUTE RESOLUTION

These Terms and any separate agreements through which we provide you Services shall be governed by and construed in accordance with the laws of India. Subject to the dispute-resolution process below, the courts at Kullu, Himachal Pradesh shall have exclusive jurisdiction over any dispute. The parties shall first attempt to resolve any dispute amicably by contacting our Grievance Officer (Section 20). Nothing in this section prevents a consumer from approaching the consumer dispute redressal forums available under the Consumer Protection Act, 2019.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates to our website. Your continued use of the site following any changes constitutes acceptance of those changes.
